General Terms and Conditions

Please read the following terms and conditions carefully and confirm that you have read, understood and accepted them in full by clicking in the box provided at the end of the text.

1. Responsibility, liability, warranty and partners

The Internet pages on www.latinconnect.com are a product of the Latinconnect umbrella brand, an alliance of independent destination management companies (DMCs) from Latin America. Overall responsibility for the platform www.latinconnect.com carries:

Technical availability: DMC Systems S.A. takes the greatest care to ensure the uninterrupted operation and freedom from viruses of the servers on www.latinconnect.com. However, no guarantee can be given that the systems will be available at all times or that they are completely free of malware.

Exclusion of liability in the event of technical failure: DMC Systems S.A. is not liable for damage caused by disruptions to lines, servers or other facilities that are not within the direct control of DMC Systems S.A. (e.g. failures of the Internet backbone or cloud providers).

Force majeure (force majeure): DMC Systems S.A. shall be released from the fulfilment of its contractual obligations if the non-fulfilment is due to circumstances of force majeure. Force majeure includes, in particular, natural disasters, war, terrorism, pandemics, strikes and official orders.

Scope of liability: Liability for direct or indirect damage (including loss of profit) is excluded, unless the damage is due to gross negligence or intent on the part of DMC Systems S.A. or its partners.

Third party content: DMC Systems S.A. accepts no liability for the accuracy, completeness and up-to-dateness of the information (prices, texts, images) provided by local partners. Similarly, no responsibility is accepted for the content of external websites to which links are provided.

2. Copyrights

All contents on the pages of www.latinconnect.com are protected by copyright. Once you have been granted access to the protected area, you are authorised to use the content (texts, prizes, photos, videos, etc.) for the duration of the active collaboration with the Latinconnect partners, subject to the following conditions:

  1. Creation of customer catalogues in PDF format.
  2. Use of the content for the production of catalogues, flyers and websites with the purpose of promoting the sale of the tourism services offered.
  3. Presentation of the content in consultations, non-commercial destination presentations or events with the purpose of promoting the sale of the tourism services offered.

It remains expressly forbidden to use content from www.latinconnect.com in any form if the resulting bookings are not processed via Latinconnect's partners. If you are working with another destination agency/DMC in one of the partner countries, the content on www.latinconnect.com of this country may not be used.

It remains expressly forbidden to take photos and videos of www.latinconnect.com in any way or to manipulate it.

Any other use of the content is prohibited and requires the written authorisation of DMC Systems S.A. or the relevant Latinconnect partner.

The right to use the content expires after termination of the active co-operation with the partners listed under point 1 or by written notification by DMC Systems S.A..

3. Data protection

Provisions on this point are not part of these General Terms and Conditions, but are conclusively regulated in a separate document «Data Protection Policy». This document is available here (LINK) and forms an integral part of the contractual agreement between the user and DMC Systems S.A. and its partners. By accepting these terms and conditions, the user confirms that he has also read, understood and accepted the provisions of this separate document.

4. Confidentiality

All content and information on www.latinconnect.com are confidential and intended exclusively for registered users, their employees and their customers. The user is expressly prohibited from forwarding content and information such as texts, prices, photos or videos to third parties, in particular to companies that are in competition with DMC Systems S.A., Latinconnect or one of its partners listed under point 1.

The user undertakes to use the access data for the pages of www.latinconnect.com confidential and to ensure that they do not fall into the wrong hands.

5. Blocking of accesses

DMC Systems S.A. reserves the right to terminate a user's access to the platform at any time. www.latinconnect.com temporarily block or permanently delete your account at any time and without prior notice if there is an important reason.

An important reason exists in particular if:

  • the user violates the provisions on copyright utilisation or confidentiality.
  • there is reasonable suspicion that the access data has been made accessible to unauthorised third parties.
  • the information provided during registration is incomplete or untrue.
  • the user uses the contents of the platform for purposes that are in direct competition with DMC Systems S.A., Latinconnect or their partners.

If the account is blocked or deleted, the right to use the content provided expires with immediate effect.

DMC Systems S.A. or its partners expressly reserve the right to assert further claims for damages.

6. Terms and conditions of the partners of Latinconnect/DMC Systems S.A.

The pages www.latinconnect.com only represent the products of the local partners in the respective destination. The local terms and conditions of the partners listed under point 1 apply to bookings.

7. Conditions for registration

The user confirms that he/she fully fulfils the following conditions for registration:

  1. The user is a tour operator, travel agency or an organisation of mobile travel consultants and is legally registered in the commercial register.
  2. The user fulfils all conditions prescribed by law and the associations in his country for the operation of his travel business.
  3. The user has the necessary decision-making authority in his company to carry out this registration process.

8. Changes to the General Terms and Conditions

DMC Systems S.A. reserves the right to amend these General Terms and Conditions at any time. Users will be informed of any significant changes by e-mail or via the platform.

9. Choice of law and place of jurisdiction

  1. All legal relationships between the user and DMC Systems S.A. shall be governed exclusively by the laws of the Republic of Costa Rica.
  2. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and any conflict of laws provisions is expressly excluded.
  3. Exclusive place of jurisdiction for all disputes arising from or in connection with the use of the platform www.latinconnect.com and these terms and conditions is San José, Costa Rica.

10. Severability clause

  1. Should individual provisions of these terms and conditions be invalid or unenforceable or become invalid or unenforceable after the user's consent, this shall not affect the validity of the remaining provisions.
  2. In place of the invalid or unenforceable provision, the parties hereby agree on a provision that comes closest to the economic purpose of the invalid or unenforceable provision.
  3. This applies accordingly in the event that these terms and conditions should prove to be incomplete.
