General Terms and Conditions<\/h1>

Please read the following terms and conditions carefully and confirm that you have read, understood and accepted them in full by clicking in the box provided at the end of the text.<\/p>

1. Responsibility, liability, warranty and partners<\/h3>

The Internet pages on www.latinconnect.com<\/a> are a product of the Latinconnect umbrella brand, an alliance of independent destination management companies (DMCs) from Latin America. Overall responsibility for the platform www.latinconnect.com<\/a> carries:<\/p>

Technical availability:<\/strong> DMC Systems S.A. takes the greatest care to ensure the uninterrupted operation and freedom from viruses of the servers on www.latinconnect.com<\/a>. However, no guarantee can be given that the systems will be available at all times or that they are completely free of malware.<\/p>

Exclusion of liability in the event of technical failure:<\/strong> DMC Systems S.A. is not liable for damage caused by disruptions to lines, servers or other facilities that are not within the direct control of DMC Systems S.A. (e.g. failures of the Internet backbone or cloud providers).<\/p>

Force majeure (force majeure):<\/strong> DMC Systems S.A. shall be released from the fulfilment of its contractual obligations if the non-fulfilment is due to circumstances of force majeure. Force majeure includes, in particular, natural disasters, war, terrorism, pandemics, strikes and official orders.<\/p>

Scope of liability:<\/strong> Liability for direct or indirect damage (including loss of profit) is excluded, unless the damage is due to gross negligence or intent on the part of DMC Systems S.A. or its partners.<\/p>

Third party content:<\/strong> DMC Systems S.A. accepts no liability for the accuracy, completeness and up-to-dateness of the information (prices, texts, images) provided by local partners. Similarly, no responsibility is accepted for the content of external websites to which links are provided.<\/p>

2. Copyrights<\/h3>

All contents on the pages of www.latinconnect.com<\/a> are protected by copyright. Once you have been granted access to the protected area, you are authorised to use the content (texts, prizes, photos, videos, etc.) for the duration of the active collaboration with the Latinconnect partners, subject to the following conditions:<\/p>

  1. Creation of customer catalogues in PDF format.<\/li>
  2. Use of the content for the production of catalogues, flyers and websites with the purpose of promoting the sale of the tourism services offered.<\/li>
  3. Presentation of the content in consultations, non-commercial destination presentations or events with the purpose of promoting the sale of the tourism services offered.<\/li><\/ol>

    It remains expressly forbidden to use content from www.latinconnect.com<\/a> in any form if the resulting bookings are not processed via Latinconnect's partners. If you are working with another destination agency\/DMC in one of the partner countries, the content on www.latinconnect.com<\/a> of this country may not be used.<\/p>

    It remains expressly forbidden to take photos and videos of www.latinconnect.com<\/a> in any way or to manipulate it.<\/p>

    Any other use of the content is prohibited and requires the written authorisation of DMC Systems S.A. or the relevant Latinconnect partner.<\/p>

    The right to use the content expires after termination of the active co-operation with the partners listed under point 1 or by written notification by DMC Systems S.A..<\/p>

    3. Data protection<\/h3>

    Provisions on this point are not part of these General Terms and Conditions, but are conclusively regulated in a separate document \u00abData Protection Policy\u00bb. This document is available here (LINK)<\/strong> and forms an integral part of the contractual agreement between the user and DMC Systems S.A. and its partners. By accepting these terms and conditions, the user confirms that he has also read, understood and accepted the provisions of this separate document.<\/p>

    4. Confidentiality<\/h3>

    All content and information on www.latinconnect.com<\/a> are confidential and intended exclusively for registered users, their employees and their customers. The user is expressly prohibited from forwarding content and information such as texts, prices, photos or videos to third parties, in particular to companies that are in competition with DMC Systems S.A., Latinconnect or one of its partners listed under point 1.<\/p>

    The user undertakes to use the access data for the pages of www.latinconnect.com<\/a> confidential and to ensure that they do not fall into the wrong hands.<\/p>

    5. Blocking of accesses<\/h3>

    DMC Systems S.A. reserves the right to terminate a user's access to the platform at any time. www.latinconnect.com<\/a> temporarily block or permanently delete your account at any time and without prior notice if there is an important reason.<\/p>
